Try with Mirra Try Before You Buy Service Terms and Conditions

Welcome to Try with Mirra's Try Before You Buy (TBYB) service. When you choose to use our TBYB service, you are agreeing to abide by the following terms and conditions:

1. Payment Methods
1.1 Standard Payment Commitment
By choosing the TBYB service, you are making a commitment to pay for any items you decide to keep. You authorise us to securely store your payment information via Shopify’s payment gateway and to charge your account for the items kept, in accordance with the trial period agreement.

1.2 Pre-Authorisation Payment Method
As an alternative to the standard payment method, some merchants may offer a "pre-authorisation" option.
By selecting this method, you agree that:
A pre-authorisation hold will be placed on your card for the total amount of the order at the time of the transaction. This is not an actual charge, but the amount will be reserved on your card to ensure funds are available.
The pre-authorised amount will be held by your bank and cannot be spent elsewhere; however, it will not be transferred to us until you decide to keep the items and complete your order.
If you choose to return all items within the trial period, the pre-authorisation hold will be released, and funds will return to your available balance according to your bank's policies.
Should you keep any items, the corresponding amount will be charged to your account, and the hold for the remaining items (if any) will be released.

2. Trial Period and Order Completion
During your trial period, you will receive notifications to complete your order in our Customer Portal. You must confirm which items you wish to keep and which to return before the trial period ends. Failing to finalise your order by the trial period's conclusion will result in the full charge for all items to the payment method on file, at which point you accept full payment liability.

3. Customer Liability for Product Damage or Theft During Trial Period
During the trial period, you are responsible for the care and security of the products. In the event of damage beyond normal wear or theft, you will be liable for the cost of repair or replacement as determined by the brand's specific policy. Please refer to the brand's terms for detailed information on liability and charges.

4. Returns and Unreturned Returns
To avoid charges, initiate the return of any unwanted items through our Customer Portal before the end of the trial period, ensuring they are in original condition. Items must be posted within 5 business days after completing the order. Failing to return items within this timeframe will result in a charge to your provided payment method for the full order amount.

5. Damaged Returns
Merchants reserve the right to charge for items that are returned in a damaged state. Items returned damaged, beyond normal wear from trying them on, may incur charges according to the merchant's returns policy.

6. Failed Payment Process
Should your payment fail upon processing post-trial period, we will contact you for alternative payment methods. Non-payment after multiple attempts may lead to actions permissible by law, including debt recovery efforts.

7. Try Restocking Fee / Return Label Fee
You agree that a non-refundable Restocking Fee may be charged if you decide to return some or all items from your order. The specific fee amount and conditions under which it is applied depend on the terms set by the brand.

8. Debt Recovery
Should there be any outstanding amounts that we are unable to collect through our standard processes, you acknowledge that we may engage a third-party debt collection service to manage the recovery of these funds. You will be responsible for any additional fees associated with the collection of the debt.

9. Data Privacy and Security
Your personal and payment information will be saved and stored by Shopify in accordance with their terms and conditions. Payment details will be removed upon the completion of the order, except as necessary to process any payments related to your TBYB order.

10. Dispute Resolution and Liability
In the event of a disagreement arising from the use of the Try Before You Buy (TBYB) service, the dispute will be addressed following the guidelines in our Dispute Resolution Policy. Try with Mirra holds no liability for transactions and interactions between customers and participating brands, including product conditions, fulfilment of orders, and returns.

11. Amendments to the Terms
We reserve the right to amend these Terms and Conditions at any time. Such amendments will become effective immediately upon posting on our website or via direct notification to you.

12. Governing Law
These terms are governed by the laws of the jurisdiction where Try with Mirra is headquartered, without regard to its conflict of law provisions.

13. Communication Consent
By using the Try Before You Buy (TBYB) service provided by Try with Mirra, you consent to receive email newsletters, promotional materials, texts, and other similar communications from Try with Mirra and its affiliated brands or partners. These communications may include but are not limited to product updates, special offers, and marketing campaigns. You understand that you can opt out of receiving these communications at any time by following the unsubscribe instructions provided in the messages or by contacting us directly at the email address support@trywithmirra.com.
